某校学生在工厂实习期间被砸伤左手,造成八级伤残,后起诉到山东省威海市文登区人民法院,要求学校和该工厂对其进行损失赔偿。 不过,于某的索赔之路并不顺畅,工厂方认为,于某作为实习生虽然是在工厂实习期间受伤,但其作为成年人,应有注意安全的义务,手受伤是其粗心大意、工作时走神所致,于某自己也应承担责任。 校方则认为,虽然于某受伤时属于该校学生,但由于是在实习工厂受伤,并不在学校内,并且学校、工厂同于某签订了三方安全协议,已经对可能发生的安全事故责任分担作出明确约定,根据约定内容,学校不应当承担于某的各项损失。 法院审理后认为,于某进入工厂后受工厂管理,并领取相应报酬,双方形成雇佣关系,根据最高人民法院 关于审理人身损害赔偿案件适用法律若干问题的解释 第十一条规定,于某是在从事雇佣活动中遭受的人身损害,其要求工厂方承担赔偿责任,符合法律规定,应予以支持。 法院认为,于某基于学校的安排到实习单位实习,由于其与实习单位之间不存在劳动关系,所以,在实习过程中受到的伤害按照一般民事侵权纠纷处理。 该案主审法官表示,根据相关法律规定,学生在校外实习与企业不存在劳动关系,不在劳动合同法规定的保护范畴内。
