KEEP VIRGINIA WATERS SAFE! There are essentially 3 parts to the laws concerning leases for water bottoms:. Leasing the bottomlands (original law was for the sole purpose of propagating shellfish). Permitting for the specific use of those bottomlands. Operations and servicing – how and when are operations taking place on these acres. The Virginia Marine Resource Commission does not require a permit for cages 12″ or less. This bypasses 28.2.1205 (see below). Article XI, Virginia Constitution / Section 1.

Bottom leases have been handed out to commercial fisherman without careful thought into how to best address a responsible way to harvest oysters commercially and keep the waterways safe for recreational users. The laws and regulations for the subaqueous lands of VA need to be updated to reflect new industries, and the values, interests and safety of the greater public.
